    Terms of Use — GaragePilot

    1. Provider Identification

    GaragePilot is operated by Gadsden Tecnologia LTDA., CNPJ 48.706.913/0001-54, headquartered in São José/SC, Brazil.

    2. Acceptance of Terms

    By creating an account, accessing, or using GaragePilot (web, Android, or iOS), you acknowledge that you have read and agree to these Terms. If you do not agree, do not use the Platform.

    3. Legal Documents and Precedence

    3.1. These Terms and the Privacy Policy are available at GaragePilot.io/legal.

    3.2. In the event of conflict between translated versions and the Brazilian Portuguese version, the Portuguese version shall prevail, unless mandatory local law requires otherwise.

    4. Who May Use the Platform

    You represent that you have the legal capacity to enter into a binding agreement. If you are under 18 (or the age of majority in your jurisdiction), you may only use the Platform with a legal guardian's consent.

    5. Definitions

    • Platform/Service: GaragePilot (web + apps).
    • End User (B2C): An individual using the Platform for personal vehicle-related purposes.
    • Service Provider (B2B): A car chaser, consultant, repair shop, company, or professional using GaragePilot to serve clients and/or manage vehicles.
    • Unprocessed Data: Data entered or uploaded by the user (e.g., license plate/VIN, mileage, history, notes, attachments).
    • Processing: Methods, routines, workflows, pipelines, heuristics, models, prompts, rules, structures, and transformations applied to data to generate results.
    • Processed Data (Outputs): Reports, recommendations, classifications, projections, indicators, and any results generated by Processing.
    • Anonymized/Aggregated Data: Data treated so that the data subject cannot be identified by reasonable technical means, used for statistics and improvement.

    6. What GaragePilot Does (and What It Does Not Do)

    6.1. GaragePilot provides organization, intelligence, and decision-support tools for vehicles, maintenance, and history.

    6.2. The Platform is not an in-person mechanical inspection, official appraisal, expert assessment, and does not guarantee the condition, value, provenance, or absence of defects of any vehicle.

    7. Account, Security, and Prohibited Use

    7.1. You are responsible for keeping your credentials secure and for all activity that occurs under your account.

    7.2. You agree not to:

    • violate any applicable laws (including privacy, consumer protection, and cybersecurity laws);
    • access third-party data without authorization;
    • attempt to exploit vulnerabilities, reverse engineer, scrape, or engage in any use that degrades the Platform.

    8. Rules for Service Providers (Car Chasers / Repair Shops)

    8.1. If you are a Service Provider, you represent that:

    • you have authorization and a legal basis to enter and share client and vehicle data;
    • you are responsible for informing your clients about how their data will be used in your service.

    8.2. The Service Provider is solely responsible for:

    • quotes, diagnostics, service execution, timelines, warranties, parts, and labor;
    • complying with legal obligations of their own business and handling client complaints.

    8.3. Gadsden is not liable for services provided by third parties, nor for damages caused by mechanical work, parts, or labor.

    9. Payments, Subscriptions, and Refunds (Web + Apps)

    9.1. Purchase Channels

    • Web: Billing via Stripe (or an equivalent provider indicated on the Platform).
    • iOS/Android: Purchases via the App Store and/or Google Play (including in-app purchases and subscriptions), possibly supported by entitlement/billing providers (e.g., RevenueCat).

    9.2. Commercial Refund Policy (Stripe / Web Only)

    This policy applies exclusively to payments processed via Stripe (web):

    • Subscriptions: Refunds are allowed within 7 (seven) days of purchase or renewal, provided the request is submitted in writing to suport@gadsden.cc and subject to applicable law.
    • Reports and one-time report generation services ("Reports"): No refunds, as the service is executed and consumed at the time of generation and is not reversible.

    9.3. App Store / Google Play Purchases

    For purchases made through app stores, refunds and cancellations follow the respective store's policies and procedures, and users should follow the processes provided by Apple/Google.

    10. Availability and Technical Limitations (Bubble, Web, and Mobile)

    10.1. The Platform uses a stack based on Bubble and third-party integrations.

    10.2. Web: The Platform uses essential cookies and/or equivalent technologies for authentication, session integrity, and operation.

    10.3. Mobile: Operating in iOS/Android environments (including WebViews and system components), session persistence and storage may vary depending on device, permissions, system policies, and updates.

    10.4. Outages may occur (maintenance, third-party failures, network issues, app stores). Gadsden may modify or discontinue features, observing active contractual commitments where applicable.

    11. Data Ownership, Intellectual Property, and Processing Confidentiality

    11.1. Your Unprocessed Data belongs to you. You retain ownership/possession of and responsibility for the content you submit, including attachments.

    11.2. You grant Gadsden a non-exclusive, worldwide license, for the duration of your use, to host, store, reproduce, process, and display your Unprocessed Data solely to:

    • provide the service;
    • maintain security, auditing, and fraud prevention;
    • comply with legal obligations;
    • improve the Platform, where feasible with anonymized/aggregated data.

    11.3. Trade Secrets and Processing IP: The Processing (methods, routines, workflows, models, rules, prompts, structure, and engineering) is the intellectual property and trade secret of Gadsden Tecnologia LTDA and is not transferred to the user.

    11.4. Processed Data (Outputs) and Usage Permissions: Outputs are provided to the user under a usage license for legitimate purposes related to the Platform. You may not:

    • attempt to reconstruct, audit, extract, infer, or copy the Processing (reverse engineering);
    • resell Outputs "as a product" at scale or as the basis of a competing service, without written authorization from Gadsden.

    11.5. Anonymized/Aggregated Data: Gadsden may retain and use anonymized and aggregated data derived from Platform usage for analytics, statistics, improvement, security, and product intelligence, including commercial purposes, without identifying the user.

    11.6. Service Provider → Client Sharing: Service Providers may share Outputs with their end clients to the extent necessary for the service provided (e.g., evaluation report), assuming responsibility for proper use and for handling client requests.

    12. User-Submitted Content

    You warrant that you have the right to submit the files and information and that you will not violate any third-party rights.

    13. Third-Party Providers and Services

    13.1. The Platform may integrate third-party services to operate, host, process payments, deliver content, generate reports, perform vehicle lookups, support AI, and enable monitoring.

    13.2. Providers currently used and/or planned (examples):

    • Bubble; AWS (Amazon Web Services);
    • NHTSA (VIN Decoder / vPIC), NMVTIS, and/or equivalent government/public services in applicable jurisdictions;
    • Stripe; RevenueCat; Google Pay; Apple Pay;
    • Google Play Store / Google; Apple App Store / Apple;
    • Vercel; imgix; GitHub;
    • OpenAI; Anthropic; Google Cloud; Google AI Studio;
    • BigDataCorp; DataOne Software; VinAudit; MarketCheck; CarMD.

    13.3. Extended non-exhaustive list to minimize update frequency: Gadsden may, at any time, use equivalent and/or additional providers, including but not limited to:

    • Public databases and government services: SERPRO, SENATRAN/Ministry of Transport (Brazil), FIPE, state DMV agencies (US), DVLA (UK), and analogous bodies in other countries;
    • Commercial vehicle data and VIN decoder providers;
    • Infrastructure and delivery: CDNs, object storage, transactional email, error/crash monitoring, push notifications, anti-fraud and KYC (where applicable);
    • AI/Models and orchestration: model providers, embeddings, moderation, and AI evaluation/monitoring tools;
    • Analytics and attribution: product metrics, events and funnel analytics, campaign attribution (where applicable).

    14. Records, Auditing, and Legal Obligations

    The Platform may maintain logs and technical records for security, fraud prevention, auditing, and legal compliance.

    15. Disclaimer and Limitation of Liability (B2C and B2B)

    15.1. Gadsden makes reasonable efforts to keep the Platform operational but does not guarantee uninterrupted operation or the absence of defects.

    15.2. Gadsden does not guarantee the completeness or timeliness of third-party databases and is not responsible for decisions made solely based on Outputs.

    15.3. Time cap: In any event, liability assessment is limited to a maximum period of 3 (three) months, per the rules below.

    15.4. Financial limit by service type:

    • Reports (one-time/individual service): Liability, where applicable, is limited to the amount paid for the report that gave rise to the claim.
    • Subscriptions/recurring contracts (B2C or B2B): Liability, where applicable, is limited to the total amount actually paid between the date of the triggering event and the date the dispute was initiated, subject to the 3-month cap.

    15.5. Nothing in these Terms excludes or limits mandatory consumer rights where applicable under local law (including but not limited to the EU Consumer Rights Directive, Australian Consumer Law, or equivalent protections).

    16. Suspension and Termination

    Gadsden may suspend or terminate accounts in cases of fraud, abuse, legal/contractual violation, or risk to the Platform/third parties, with proportionate measures.

    17. Changes to Terms

    Gadsden may update these Terms. Material changes will be communicated via the app/website, with a new effective date.

    18. Governing Law and Jurisdiction

    These Terms are governed by the laws of the Federative Republic of Brazil. The courts of Florianópolis, Santa Catarina, Brazil shall have jurisdiction, subject to mandatory legal rules applicable in your jurisdiction.

    For users in the EU/EEA, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence. For users in Australia, statutory guarantees under the Australian Consumer Law apply to the extent required. For users in other jurisdictions, mandatory local consumer protections are preserved.

    19. International Expansion

    If the service is offered in other countries, local addenda may apply (language, legal bases, taxes, dispute resolution).
